Fall Cleanup: Don’t Let Leaves Create a Liability Problem

Falling leaves are part of the season, but for HOA and condominium communities they can also create a surprisingly simple source of property damage and liability claims.
Wet leaves on sidewalks, stairs, and parking areas can become extremely slippery. Boards and managers should make sure landscaping and maintenance vendors have a plan for regularly clearing high-traffic areas—not just completing one large cleanup at the end of the season.
Leaves can also create problems above ground. Clogged gutters, roof drains, and downspouts can cause water to back up and find its way into buildings. For communities with flat or low-slope roofs, keeping roof drains clear is especially important as leaves begin to fall.
This is also a good time to review vendor responsibilities. Who is responsible for clearing sidewalks? What happens after a weekend storm? Are vendors documenting when work is performed? A simple service log can be helpful if someone later alleges that the association failed to maintain a common area.
Fall cleanup may seem routine, but good maintenance is also good risk management. Keeping walking surfaces and drainage systems clear is one of the easiest ways an association can help prevent both injuries and water losses this time of year.
